These Terms and Conditions ("Terms") apply when you use ppeclub.com.au (the "Website") or buy products or services from PPE Club ("PPE Club", "we", "us", "our"), ABN 32 670 380 668, 497 Abernethy Road, Kewdale WA 6105. "You" means the person or business using the Website or placing an order. By using the Website or placing an order you agree to these Terms, together with our Privacy Policy, Shipping Policy and Refund Policy.
Your rights under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded. If any part of these Terms is inconsistent with those rights, your rights under the law prevail.
Part A — Using our Website
1. Access and accounts
1.1 You must be at least 18 years old to place an order, or have the involvement of a parent or guardian.
1.2 If you create a customer account, you are responsible for keeping your login details secure and for activity on your account. Tell us promptly if you think your account has been used without your permission.
1.3 You must provide accurate, current details when you register, place an order or contact us.
1.4 We may suspend or close an account, or refuse service, where we reasonably believe it is being used fraudulently, unlawfully or in breach of these Terms.
2. Acceptable use
You must not use the Website to: break any law; interfere with or attempt to gain unauthorised access to the Website, our systems or other users' accounts; upload malicious code; scrape, copy or harvest content or data by automated means without our written consent; post reviews or content that is false, misleading, defamatory, offensive or infringes someone else's rights; or impersonate any person or business.
3. Website availability and information
3.1 We work to keep the Website accurate and available, but we can't promise it will be uninterrupted or free of errors. We may update, suspend or change the Website at any time.
3.2 Product images are for illustration. Colours, textures and finishes can look different on different screens, and manufacturers may update packaging or minor specifications without notice. If a product you receive is materially different from its description, you have the remedies described in clause 13.
3.3 Links to third-party websites (including brand and manufacturer sites) are provided for convenience. We are not responsible for their content or practices.
4. Intellectual property
The PPE Club name, logos, slogans, Website design, text, graphics and original photography are owned by or licensed to PPE Club. Brand names, logos and product images of the manufacturers we stock belong to their respective owners. You may view and print pages for personal or internal business use, but you must not otherwise copy, reproduce, republish or commercially use Website content without our prior written permission.
5. Reviews and content you submit
If you submit a review, photo, comment or other content, you confirm it is your honest opinion or your own work and that you have the right to share it. You give us a non-exclusive, royalty-free licence to use, display and reproduce that content on our Website, social media and marketing. We may moderate or remove content that breaches these Terms, but we will not remove or suppress genuine reviews simply because they are negative.
6. Privacy and cookies
We collect, use and protect personal information in line with the Privacy Act 1988 (Cth) and our Privacy Policy. Our Website (powered by Shopify) uses cookies and similar technologies to run the store, remember your cart and preferences, and understand how the site is used. You can control cookies through your browser settings, but some features may not work without them. Marketing emails and SMS are sent only with your consent, and every message includes a way to unsubscribe.
Part B — Orders, Pricing and Payment
7. Orders
7.1 Placing an order is an offer to buy. We'll email an order confirmation when we receive it; a contract is formed when we accept your order, which happens when we despatch the goods or confirm the order is ready for pick-up.
7.2 We may decline or cancel an order (in whole or in part) before acceptance, for example if an item is out of stock, a pricing or listing error has occurred, we can't verify payment, we suspect fraud, or the order quantity suggests resale where stock is limited. If we cancel after you've paid, we'll refund the amount paid for the cancelled items in full to your original payment method.
7.3 You can ask to cancel or change an order by emailing us before it is despatched. Once an order has been despatched, our Refund Policy applies. Custom and branded orders can't be cancelled once production has started (see clause 16).
8. Stock availability
Stock levels shown on the Website are updated regularly but may not always be exact, as we also supply trade customers and other sales channels. If an item you've ordered is unavailable, we'll contact you and offer a suitable alternative, a back-order with an estimated lead time, or a full refund for that item — your choice.
9. Pricing
9.1 All prices are in Australian dollars (AUD) and include GST.
9.2 Delivery charges are shown separately and calculated at checkout before you pay. We won't add any other mandatory fee that isn't shown at checkout.
9.3 We may change prices at any time, but a price change won't affect an order we've already accepted.
9.4 If a product is listed at an obviously incorrect price (for example due to a typographical or system error), we'll contact you before processing the order and give you the option to proceed at the correct price or cancel for a full refund.
10. Payment
10.1 Payment is due in full at checkout using one of the payment methods shown at checkout (such as debit and credit cards, digital wallets and Afterpay). Payments are processed securely by Shopify and our payment providers; we do not store your full card details.
10.2 We do not charge card surcharges.
10.3 Buy-now-pay-later services such as Afterpay are provided by third parties under their own terms, including their own eligibility checks and fees. Any refund on an Afterpay order is returned to your Afterpay account.
10.4 Approved business customers may be offered invoice or account terms. Those terms (including payment due dates) will be confirmed in writing on your quote or account application and apply in addition to these Terms.
11. Discounts, membership and promotions
11.1 PPE Club membership is free. Members who are logged in to their account receive the member discount shown on the Website (currently 5%) automatically at checkout on eligible products. We may change or end the membership program or its benefits by updating the Website, but changes won't affect orders already placed.
11.2 Discount codes and promotional offers are subject to the conditions shown with them (such as expiry dates, minimum spend or excluded products). Unless stated otherwise, they can't be redeemed for cash, combined with other offers, or applied to past orders.
11.3 Competitions, giveaways and trade promotions run by us or with our brand partners are governed by their own published terms, which apply in addition to these Terms.
Part C — Delivery and Collection
12. Delivery
12.1 We currently deliver within Australia only.
12.2 In-stock items ordered before 3pm AWST on a business day are generally despatched the same day from our Perth warehouse. Items not held in stock, back-ordered items and custom or branded orders have longer lead times, which we'll advise.
12.3 Delivery timeframes provided by us or our carriers are estimates only (typically 2–8 business days after despatch, longer for regional and remote areas). We'll keep you informed of any significant delay we become aware of.
12.4 Please check your delivery address carefully. If a parcel is returned to us because of an incorrect address or failed delivery attempts, we may charge the cost of re-sending it.
12.5 If you choose "authority to leave", you accept that the parcel will be left at the address without a signature. Risk in the goods passes to you when they are delivered (or left as authorised) or collected. Ownership passes to you once we receive full payment.
12.6 If your parcel is lost or damaged in transit, contact us and we'll work with the carrier to resolve it, including replacing or refunding the goods where required.
12.7 Pick-up: Where pick-up from our Kewdale warehouse is offered at checkout, please wait for your "ready for pick-up" notification and bring your order number and photo ID. If an order isn't collected within a reasonable time, we'll try to contact you before cancelling it and refunding you in full.
Part D — Returns, Faulty Goods and Warranties
13. Consumer guarantees and faulty goods
13.1 Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
13.2 If you believe an item is faulty, damaged, incorrect or not as described, please contact us at hello@ppeclub.com.au with your order number, a description of the problem and photos where possible. There is no fixed cut-off for raising a genuine fault — your rights last for a reasonable time depending on the product, its price and how it has been used — but contacting us promptly helps us resolve it faster.
13.3 For faulty, incorrect or damaged goods, we'll cover reasonable return postage and provide the remedy you're entitled to under the Australian Consumer Law. We may need to inspect the item or refer it to the manufacturer to assess the fault.
13.4 Normal wear and tear, damage from misuse, accidents, incorrect care or washing, alterations, or use outside the product's intended purpose or rated standard are not faults.
14. Manufacturer warranties
Many products we sell (for example safety footwear and some workwear) carry a manufacturer's warranty. These warranties are provided in addition to, and do not limit, your rights under the Australian Consumer Law. We're happy to help lodge a warranty claim with the manufacturer on your behalf.
15. Change-of-mind returns and exchanges
15.1 We're not required by law to accept change-of-mind returns, but we offer them on eligible items within 14 days of delivery, provided the item is unused and unworn, in its original condition and packaging with tags attached, and you have proof of purchase.
15.2 Please email us before sending anything back so we can confirm the return. You pay the cost of return postage for change-of-mind returns and exchanges, and we recommend a tracked service as items remain your responsibility until they reach us. Returns are sent to: PPE Club, 497 Abernethy Road, Kewdale WA 6105.
15.3 For a size exchange, include a prepaid Australia Post satchel with your return and we'll send the new size in it (subject to stock).
15.4 Once we receive and inspect your return, we'll refund the item price to your original payment method. Original delivery charges are not refunded for change-of-mind returns. Your bank or payment provider may take several business days to process the refund.
15.5 The following are not eligible for change-of-mind returns (but are still covered by the consumer guarantees if faulty): custom, embroidered, heat-sealed or otherwise branded items; special or indent orders; opened hygiene and single-use items (such as disposable respirators and masks, earplugs, first aid consumables and socks); items marked as final sale or clearance; and gift cards.
Part E — Uniforms, Branding and Business Orders
16. Custom branding (embroidery and heat seal)
16.1 Branding services are subject to the minimum order quantity, setup fees and pricing shown on our Branding page or in your written quote.
16.2 We'll provide a digital proof for your approval before production. Please check spelling, colours, sizes and placement carefully — once you approve the proof, production begins and the order can't be cancelled or changed.
16.3 You confirm that you own or have permission to use any logo, name or artwork you supply, and you agree to indemnify us against any claim that our use of that artwork as instructed by you infringes someone else's rights. We may refuse artwork we consider offensive or unlawful.
16.4 Small variations in thread or print colour, and in placement, are normal for decorated garments and are not a defect. Branded goods are made to your order and can't be returned for change of mind, sizing or other non-fault reasons, so please confirm sizes before ordering.
17. Business and bulk orders
17.1 Quotes are valid for the period stated on the quote and are subject to stock availability at the time of order.
17.2 If you buy goods for resale, or for use in manufacturing, or the goods are not "consumer goods" under the Australian Consumer Law, then to the extent the law allows, our liability for a failure to meet a consumer guarantee is limited to (at our choice) replacing the goods or supplying equivalent goods, repairing the goods, or paying the cost of replacement or repair.
17.3 Nothing in these Terms is intended to be an unfair contract term. If any clause would be unfair in a consumer or small business contract, it will be read down or severed to the extent necessary.
Part F — Safety Products and Liability
18. Choosing the right PPE
18.1 Product descriptions, standard ratings (for example AS/NZS) and any guidance we give are general information only, based on manufacturer data and the details you provide. They are not a workplace risk assessment or professional safety advice.
18.2 Employers and workers remain responsible for meeting their obligations under applicable work health and safety laws, including assessing workplace hazards and selecting, fitting, maintaining and replacing PPE that is suitable for the task. Always read and follow the manufacturer's instructions, size and fit guides, care labels and replacement schedules, and check that the product's rated standard meets your site requirements.
18.3 If you're unsure whether a product is suitable, please contact us before buying, or seek advice from a qualified WHS professional.
19. Product recalls
If a product we've sold to you becomes subject to a safety recall, we'll take reasonable steps to notify you using the contact details from your order and follow the manufacturer's or regulator's recall instructions.
20. Limitation of liability
20.1 Subject to clause 13 and your rights under the Australian Consumer Law, and to the maximum extent permitted by law, we are not liable for any indirect or consequential loss (including loss of profit, revenue or business opportunity) arising from your use of the Website or our products.
20.2 We are not liable for loss or harm to the extent it is caused by misuse of a product, use contrary to the manufacturer's instructions, use in an application the product is not rated for, or failure to replace a product at the end of its service life.
20.3 Nothing in this clause limits liability for death or personal injury caused by our negligence, or any liability that cannot be excluded by law.
Part G — General
21. Events outside our control
We aren't responsible for delays or failures caused by events reasonably beyond our control, such as natural disasters, extreme weather, carrier or supply-chain disruptions, industrial action, pandemics or outages of third-party systems. If such an event affects your order, we'll let you know and you can cancel for a refund of any undelivered goods.
22. Changes to these Terms
We may update these Terms from time to time to reflect changes in the law, our services or how we operate. The updated Terms will be published on this page with a new "last updated" date. The Terms that applied when you placed an order will apply to that order.
23. Complaints and disputes
If you have a complaint, please contact us first at hello@ppeclub.com.au and we'll respond as soon as we can and work to resolve it fairly. If we can't resolve it, you can contact Consumer Protection WA or your local state or territory consumer affairs agency.
24. Governing law
These Terms are governed by the laws of Western Australia and the Commonwealth of Australia. Each party submits to the non-exclusive jurisdiction of the courts of Western Australia. If you live in another state or territory, nothing in this clause removes any right you have to bring proceedings in your own jurisdiction.
25. Other terms
25.1 If any part of these Terms is invalid or unenforceable, it will be read down or severed, and the rest of the Terms will continue to apply.
25.2 If we don't enforce a right under these Terms straight away, we can still enforce it later.
25.3 These Terms, together with the policies referred to above and any written quote or account terms we agree with you, form the entire agreement between us for your order.
